MEMBERSHIP TERMS & CONDITIONS

JUNIOR & ADULT MEMBERSHIP AGREEMENTS

Effective 10 May 2019

UNDERSTANDING

1. You are enrolling the above participant/s with KW & BS Investments Pty Ltd t/as Southside Muay Thai and Fitness (SSMT) starting on the specified date.

2. If the participant/s is under 18 years of age, the undersigned must be a legal guardian.

3. The participant/s is approved to attend the scheduled classes for the enrolled program and pledge to abide by the rules and regulations of SSMT and its staff.

4. You accept that class schedules and programs are subject to change at any time.

5. You agree to the dates, amounts and terms specified in this agreement.

6. You understand that membership fees are payable regardless of whether you attend scheduled classes for the enrolled program.

7. You authorise payment to be charged to your credit card provided verbally to SSMT, in person or via this electronic form.

8. Entering into a membership is deemed as acceptance of these terms and conditions, as varied from time to time.

GENERAL PROVISIONS

1. Failure to attend class is not notification to cancel this agreement.

2. The undersigned assumes all responsibility for any costs of collection, including but not limited to collection agency fees, court costs, legal fees, and late charges incurred for default payments.

3. SSMT may make any modifications to the class schedule as necessary. Changes to the class schedule will not relieve the undersigned of their contractual or payment obligations.

4. SSMT may close for maintenance, special events and public holidays or for other reasons for a period not exceeding four weeks per year, without affecting membership payments.

5. By entering this agreement, the undersigned grants SSMT permission to use photographs, videotapes, artwork or other likenesses of the member for marketing, trade, publishing or any other lawful purpose.

6. The participant agrees not to take the martial arts training provided to the participant by SSMT, and engage in teaching practices at another martial arts school within 50 kilometers from SSMT, for a period of three years following disassociation from SSMT, unless written permission is provided by the Directors of SSMT.

7. Payment of membership fees does not guarantee rank advancement by SSMT instructors.

8. The undersigned authorises use of the provided contact information such as phone, sms, address and email for contact and billing purposes.

9. The sharing of equipment such as gloves, hand wraps and shin pads is a health risk, and a recreational safety issue to all members. Therefore, it is compulsory for you to purchase your own equipment, and to attend class in a clean uniform with the necessary equipment as specified by the program (shorts, towel, SSMT grade level singlet, hand wraps, gloves, groin guard, mouth guard).

10. Training without a t-shirt or singlet and exposing a naked upper body is strictly prohibited.

11. For health and safety reasons, members who arrive more than 5 minutes late for a class will not be permitted to begin training in that class.

JUNIOR CLASSES/PROGRAMS/CHALLENGES (AGES 8-12)

SPECIFIC PROVISIONS

28 DAY PROGRAM FOR KIDS

** INITIAL 28 DAY PROGRAM FOR KIDS TOTALS $79.00 **

CONTINUING DIRECT DEBITS WILL BEGIN FOR A JUNIOR TIGERS BASIC 6 MONTH MEMBERSHIP AFTER THE 28 DAY PROGRAM HAS BEEN COMPLETED, UNLESS CANCELLED - SEE BELOW:

1. The 28 Day Program For Kids will roll-over into a “Junior Tigers Basic 6 Month Membership" at $18/week for a minimum term of 6 months, beginning after the challenge period is complete. Should you wish to rollover onto a different membership type, plus contact us on the email below before expiry of the 28 Day Program.

2. You may cancel the roll-over anytime in the first 25 days of the program. To cancel the roll-over, email info@southsidemuaythai.com.au to confirm you will not be continuing after the 28 Days. A confirmation email will be sent back. If no confirmation is received within 24 hours, phone 0416 140 612 immediately.

3. The 28 Day Program ($79) is non refundable or transferable.

4. Your first class is called an Introduction/Orientation Class. This class must be booked.

MEMBERSHIPS

(INCLUDING POST 28 DAY PROGRAM PERIOD)

“JUNIOR TIGERS BASIC 6 MONTH", "JUNIOR TIGERS PART TIME 6 MONTH" & "JUNIOR TIGERS FULL TIME 6 MONTH" MEMBERSHIPS

ACCESS

1. "Junior Tigers Basic 6 Month" memberships provide for a maximum attendance of 1 junior tigers class in any 1 calendar week.

2. "Junior Tigers Part Time 6 Month" memberships provide for a maximum attendance of up 2 junior tigers class in any 1 calendar week.

3. "Junior Tigers Full Time 6 Month" memberships provide for a maximum attendance of up 3 junior tigers class in any 1 calendar week.

ONGOING MEMBERSHIP FEE

1. Membership fees are charged by third party direct debit agent, EziDebit.

2. You are responsible for making sure that there are sufficient funds in the specified account on the day scheduled for debit.

3. If your payment is rejected, not made or is late, you will be required to abide by the conditions of the EziDebit service agreement, including their associated late fees or charges.

EXPIRY

1. After expiry of an expiry date, the membership will continue on the same payment basis. Regular membership fees will continue to be debited as per the agreement and the terms of this agreement will continue to apply.

2. SSMT may opt to renew the participant's membership agreement upon expiry. In this circumstance, a new agreement will be entered into and signed by the participant or guardian.

3. At no time before the expiry date will SSMT increase the membership fees.

4. After the agreement expiry date, SSMT may opt to increase the membership fees as necessary. If so, the participant or guardian will be notified and the direct debits will be adjusted as required, without further action required from the participant.

COOLING OFF PERIOD

1. By signing this agreement, you may cancel this agreement by midnight of the third business day after the date this agreement is signed, (excluding Sundays or holidays) with no cancellation fees due.

2. Cancellation must be in writing and sent by registered mail to SSMT.

3. Any membership fees already paid will not be refunded in any circumstance.

4. If the undersigned misses the three-day cancellation period, the regular cancellation policy will apply.

5. The purchase of equipment is not refundable.

ARREARS (UNPAID/OVERDUE) MEMBERSHIP FEES

1. If your account is in arrears, you may not be authorised to attend classes until the arrears amount is paid in full (including any late fees), unless otherwise approved by SSMT.

2. If your account is in arrears, you may be contacted directly by EziDebit and/or a debt recovery agent.

3. A failed transaction fee of $10 per failed transaction may be applied to your account at SSMT’s discretion.

4. If you make no effort to balance your account or communicate with SSMT, your agreement will be forwarded to a SSMT debt recovery agent for further action; where you will be responsible for all costs incurred, and remain liable for all outstanding payment obligations.

5. Failed payments will be automatically re-attempted after 24 hours and may continue to be re-attempted as necessary.

CANCELLATION POLICY 

“JUNIOR TIGERS BASIC 6 MONTH", "JUNIOR TIGERS PART TIME 6 MONTH" & "JUNIOR TIGERS FULL TIME 6 MONTH" MEMBERSHIPS

1. "Junior Tigers Basic 6 Month", “Junior Tigers Part Time 6 Month” and “Junior Tigers Full Time 6 Month" memberships are under a six-month term, and expire only on midnight 6 months from the start date of this membership.

2. The terms of this agreement are binding from the date this agreement is signed, regardless of the membership start date.

3. If you wish to cancel your membership, you must meet the following requirements:

a. Provide a dated cancellation notice in writing to SSMT. An email is accepted as written cancellation and must be emailed to SSMT at info@southsidemuaythai.com.au. Verbal requests will not be accepted.

b. Cancellation is not permitted where membership fees are in arrears.

c. Cancellation sent via email will be replied to when the cancellation is processed. If you do not receive a confirmation of receipt within 7 days, please contact SSMT immediately.

d. If cancellation occurs within the contracted agreement term, all fees are to be paid in full by regular direct debit or in one lump sum. Lump sum payments are 50% of the amount payable remaining under the membership term, as advised by SSMT. Payment of a lump sum will be classed as satisfying all cancellation fee requirements, releasing all outstanding contractual obligations.

e. If outside of the contracted agreement term, you must allow a minimum of 14 days' notice in writing, with membership fees to be paid in full as regular direct debits for a period of 14 days from the date of the written cancellation (class attendance is allowed during this period). A cancellation fee of $10 will be applied to your account. After the 14 day period, the membership will no longer be active and no additional fees will be charged.

f. Cancellation fees will not apply if you are deployed by the Australian armed forces for a period longer than 2 months. Full identification in addition to an official letter of deployment will be required as proof. In this circumstance, you must allow a minimum of 14 days' notice in writing with all membership fees to be paid in full by regular direct debit for a period of 14 days from the date of the written notice, but after the 14-day period no additional fees will be charged.

g. Cancellation fees will not apply if you develop a full permanent disability, which prohibits you from utilising any programs at SSMT. You may cancel your membership by providing sufficient medical records as proof of disability. In this circumstance, you must allow a minimum of 14 days' notice in writing with all membership fees to be paid in full by regular direct debit for a period of 14 days from the date of the written notice, but after the 14-day period no additional fees will be charged.

SUSPENSION (HOLD) OF MEMBERSHIP POLICY

“JUNIOR TIGERS BASIC 6 MONTH", "JUNIOR TIGERS PART TIME 6 MONTH" & "JUNIOR TIGERS FULL TIME 6 MONTH" MEMBERSHIPS

1. You may suspend your membership where medically prevented from participating in any of the SSMT classes. You must supply a signed letter from your physician, specifying the dates you are not able to participate.

a. In this circumstance, you must allow a minimum of 21 days notice in writing to SSMT, with all membership fees to be paid in full by regular direct debit for a period of 21 days from the date of the written suspension (class attendance is allowed during this period). A suspension fee of $10 will be applied to your account. After the 21 day period, the membership will be suspended.

2. You may also suspend your membership for reasons which are not medically related, for a maximum period of up to 28 days.

a. In this circumstance, you must allow a minimum of 21 days notice in writing to SSMT, with all membership fees to be paid in full by regular direct debit for a period of 21 days from the date of the written suspension (class attendance is allowed during this period). A suspension fee of $10 will be applied to your account. After the 21 day period, your membership will be suspended.

3. The period for which the membership is suspended will be automatically added onto the end of the membership expiry date, to total 6 months of active membership.

4. An email is accepted as written suspension and must be emailed to SSMT at info@southsidemuaythai.com.au. Verbal requests will not be accepted.

ADULT CLASSES/PROGRAMS/CHALLENGES (AGES 13+)

SPECIFIC PROVISIONS

28 DAY KICKSTARTER/TRANSFORMATION PROGRAM/CHALLENGE

** INITIAL 28 DAY PROGRAM TOTALS $149.00 **

CONTINUING DIRECT DEBITS WILL BEGIN FOR A BASIC MEMBERSHIP AFTER THE 28 DAY KICKSTARTER/TRANSFORMATION PROGRAM/CHALLENGE HAS BEEN COMPLETED, UNLESS CANCELLED - SEE BELOW:

1. The 28 Day Kickstarter/Transformation Program/Challenge will roll-over into a “Basic 6 Month” Membership at $35/week for a minimum term of 6 months, beginning after the challenge period is complete. Should you wish to rollover onto a different membership type, plus contact us on the email below before expiry of the 28 Day Kickstarter/Transformation Program/Challenge.

2. You may cancel the roll-over anytime in the first 25 days of the program. To cancel the roll-over, email info@southsidemuaythai.com.au to confirm you will not be continuing after the 28 Days. A confirmation email will be sent back. If no confirmation is received within 24 hours, phone 0416 140 612 immediately.

3. The 28 Day Program/Challenge ($149) is non refundable or transferable.

MEMBERSHIPS

(INCLUDING POST 28 DAY KICKSTARTER/TRANSFORMATION PROGRAM/CHALLENGE PERIOD)

“12 MONTH ‘UPFRONT’” & "FULL TIME 12 MONTH UPFRONT" MEMBERSHIPS

  1. "12 Month ‘Upfront’" and "Full Time 12 Month Upfront" memberships are under a twelve-month term, and expire only on midnight 12 months from the start date of this membership.
  2. The terms of this agreement are binding from the date this agreement is signed, regardless of the membership start date.
  3. "12 Month ‘Upfront’" and "Full Time 12 Month Upfront" memberships are non-refundable or transferable.
  4. "12 Month ‘Upfront’" and "Full Time 12 Month Upfront" memberships provide for unlimited attendance to all classes, subject to age restrictions.
  5. Upon expiry, "12 Month ‘Upfront’" and "Full Time 12 Month Upfront" memberships will roll-over into a “Basic 6 Month” Membership at $35/week for a minimum term of 6 months. I may cancel the roll-over anytime during the 25 days preceding expiry of the "12 Month ‘Upfront’" or "Full Time 12 Month Upfront" membership. To cancel the roll-over, email info@southsidemuaythai.com.au to confirm you will not be continuing past the "12 Month ‘Upfront’" or "Full Time 12 Month Upfront" membership term. A confirmation email will be sent back. If no confirmation is received within 24 hours, phone 0416 140 612 immediately.

“FULL TIME 6 & 12 MONTH” & “BASIC 6 & 12 MONTH” MEMBERSHIPS

ACCESS

  1. "Full-time 6 & 12 month" memberships provide for unlimited attendance to all classes, subject to age restrictions.
  2. "Basic 6 & 12 month" memberships provide for a maximum attendance of up to 3 classes in any 1 calendar week, subject to age restrictions

“FULL TIME 6 & 12 MONTH”, “BASIC 6 & 12 MONTH”, “CASUAL ‘NO CONTRACT’” & “12 MONTH ‘CONTRACT’” MEMBERSHIPS

ONGOING MEMBERSHIP FEE

“FULL TIME 6 & 12 MONTH”, “BASIC 6 & 12 MONTH” & “12 MONTH ‘CONTRACT’” MEMBERSHIPS

  1. “Full time 12 month”, “Basic 12 month” and12 month ‘contract’” memberships are under a twelve-month term, and expire only on midnight 12 months from the start date of this membership.
  2. “Full time 6 month” and “Basic 6 month” memberships, are under a six-month term, and expire only on midnight 6 months from the start date of this membership.
  3. The terms of this agreement are binding from the date this agreement is signed, regardless of the membership start date.
  4. If you wish to cancel your membership, you must meet the following requirements:
    1. Provide a dated cancellation notice in writing to SSMT. An email is accepted as written cancellation and must be emailed to SSMT at info@southsidemuaythai.com.au. Verbal requests will not be accepted.
    2. Cancellation is not permitted where membership fees are in arrears.
    3. Cancellation sent via email will be replied to when the cancellation is processed. If you do not receive a confirmation of receipt within 7 days, please contact SSMT immediately.
    4. If cancellation occurs within the contracted agreement term, all fees are to be paid in full by regular direct debit or in one lump sum.   1. “Casual ‘no contract’” memberships are under no fixed term and expire only on midnight, 14 days from the date a written notice is received by SSMT, being an undefined period from the start date of this membership.
  2. The terms of this agreement are binding from the date this agreement is signed, regardless of the membership start date.
  3. If you wish to cancel your membership, you must meet the following requirements:
    1. Provide a dated, cancellation notice in writing to SSMT. An email is accepted as written cancellation and must be emailed to SSMT at info@southsidemuaythai.com.au. Verbal requests will not be accepted.
    2. Cancellation is not permitted where membership fees are in arrears.
    3. A cancellation sent via email will be replied to when the cancellation is processed. If you do not receive a confirmation of receipt within 7 days, please contact SSMT immediately.
    4.   1. You may suspend your membership by providing a minimum of 14 days notice in writing to SSMT. All membership fees are to be paid in full by regular direct debit for a period of 14 days from the date of the written suspension (class attendance is allowed during this period). A suspension fee of $10 will be applied to your account. After the 14 day period, the membership will be suspended and no additional fees will be charged.
  2. An email is accepted as written suspension and must be emailed to SSMT at info@southsidemuaythai.com.au, by advising of the start and finish date of the suspension. Verbal requests will not be accepted.
